No, unless you have the consent of one of the individuals involved. Generally, it is illegal to secretly record oral communications between two or more individuals unless you have the consent of at least one of the individuals involved, or you are one of the parties to the conversation. There is a general prohibition against interception of private communications of others by use of electronic or other devices which carry heavy fines and even imprisonment in some cases.
Private Investigators must follow industry regulations and municipal, provincial and federal laws. The industry is regulated in Ontario by the Private Security and Investigative Services Act (PSISA) and a code of conduct. A Private Investigator is not allowed to hold themselves out as a police officer or law enforcement. Private Investigators should also respect an individual’s right to privacy and the protections afforded by the Canadian Charter of Rights and Freedoms and privacy laws which apply to surveillance activities or the collection and use of personal information.
